Basically they copied all the design and even our logo down to the actual URLs.
I've added their CEO on WeChat and inquired about this, and he said they are big fans of our startup. But he also mentioned that they already have investors. Their website launched two days ago and already has a bunch of activity.
We've talked about this internally and hope to be able to gain this startup as a Chinese subsidiary, but we are still unsure if this will actually work out.
From a legal standpoint we are very unsure how much you can actually do in such a case. Should we just wait it out? Our should we aim to litigate to put pressure on their investors? I have some experience in international litigation in cybercrime cases, but from a practical perspective it is very likely to bind a lot of resources and focus.
Another huge problem for us is that we are in talks with a very large Chinese IT company (triple-digit $Bn market cap), and if there is a clone growing in their backyard they might pass on us.
It'd be great if people with more experience in these things could give us some advice.

,DIY, Outsource, Partner... How should I approach creation?Hi all. I come here for some advice. Like plenty of others, I have an idea for an internet business. I know that an idea isn't worth much though if you don't act on it and execute. So, I've been trying my hardest to do what I can. I'm not technical, but I've been been working in all the ways I know how and learning what I don't.
I've developed the idea, asked potential customers questions, got feedback. I know it has potential. So, I designed the website wireframe, business model, marketing model, logo...
But now comes the time where something useable needs to be created. I can show potential customers a wireframe and ask them questions, but until they actually show they are willing to use (and pay) for it, I know I don't have any real traction.
I come here asking for advice on how I should approach creation. There seem to be three approaches:
1. Do it yourselfn2. Outsourcen3. Find a co-founder
Now, I am determined to learn to the technical side regardless. I've started on that journey, tackling HTML, CSS, and Javascript. I'm no expert, but I understand. I want to go after PHP as well. However, I know I don't have time to be professionally proficient in a reasonable time. It won't stop me from learning, but I'm not sure if it's the smartest way to approach this. But please, tell me if I'm wrong. I don't underestimate the amount of work/experience needed to be a great coder though... so I don't expect to be good enough in a few months.
In regards to outsourcing, I have a good amount of money saved, enough to hopefully create something. However, that something might not even be close to the end goal... and then what? What about when customers ask for more? What about maintenance? What if I do go to investors and it's just me... sure, I consider myself valuable on both the business and design end of things, but with no one to cover the technical aspects, who will want to invest? Which brings me to...
Finding a technical co-founder. I'm from NYC and plan on going to some startup meetings I've found out about. However, I know this is a scary proposition as well. For one, I have nothing created, so will anyone want to even come on board? Then I guess I need to assess options 1 & 2.
I just am looking for some guidance here. I'm at this standstill and I feel overwhelmed with all the options and just pick a direction and go. If that's outsource and then find a technical co-founder once something is implemented, then I'll tackle outsourcing now. If it's DIY, then pick up my pace (hell, quit my job, live at home and make studying and creating my new job) so I can get things going. If it's find a technical co-founder, than go out there and prove myself.

Parade uses software to guide founders through early branding decisions, including designing a basic logo, selecting fonts, selecting colors, and defining their company’s overall aesthetic.
A lot of early stage founders are incredible engineers, but lack the ability to make things look “right”. We’ve seen a bunch of our friends launch products to no reception, some of which seemed due to poor design decisions (like, making buttons hard to find or a landing page that looks like it might steal your credit card).
Two years ago, two of my closest friends started a company, raised a small round, and spent tens of thousands of dollars on their initial branding. That was a substantial percentage of their funding, and then their brand entirely changed once they learned more about their customer. After I saw them waste a ton of time and money on this, I realized that it ought to be possible to build software that could have done just as good of a job as the design agency. At the core of it, the designers asked my friends a bunch of questions about how they want their company to be perceived by customers, offered them colors and fonts and a design aesthetic that conveyed those feelings, and then created a mockup of a website that incorporated those elements. So, I decided to build software to do just that.
With Parade, we have taken a traditional brand design interview and turned it into a self-serve software product. You answer a series of questions about how you want your brand to be perceived and receive design aesthetic suggestions based on them. We use machine learning to identify design elements (such as fonts, colors, layouts, use of color, density of information, line and button styles, and visuals) that project the way you want your brand to feel, then present them to you as simple choices. To power the suggestions, we collected training data from both designers and non-designers to understand what emotional reactions these design elements evoke. Because of this technology, we are able to identify the design aesthetics that you want without having to iterate repeatedly or spend hours searching for inspiration. After you make your choices, we use the math behind design theory (such as an algorithm to expand one color into a range of colors that accounts for the difference in perceived contrast based on hue, saturation, and lightness) to flesh out your brand [0].
Right now, after onboarding, you are able to access all of your design elements in a style guide for free through the dashboard. It includes your colors and your fonts, plus a place to download your logo and icon in a few colors. - Messaging with push notifications only - nowadays you can reply directly from push notifications. So no chat lists, no list of messages or such. You reply directly via push notification

,Anybody dealing with the VID/PID USB issue for small open source projects?Anyone dealing with the VID/PID issue for opensource projects?
E.g. Start a Open Serial Bus org perhaps to highjack some abandoned VID spaces?

If I recall, USB-IF is pretty hostile to small players distributing only a few products like open sourced projects.
I wonder if there has been any progress in this matter. If not... then has there been any efforts to at least hijack a VID space from a dead company, and coordinate the distribution of the PID numbers for open sourced projects.
On dealing with the USB markings, is it possible to perhaps design a logo that is different enough from the logo USB, but is distinct enough to not be a legal concern?
If so, then we should call this logo "Open Serial Bus", maybe the shape of the logo could be a silhouette of a usb plug, but superimposed over the open hardware lock&gears.

While we are at it, might be also nice to provide a consistent method for non-standard signals to interface with such "Open Serial Bus" devices. E.g. I saw some phone re-purposed the micro usb connectors to enable or output TTL serial pin outs in place of D+ & D- with a special signal to the ID pin. Sounds very useful. (In that particular case, perhaps a one wire eeprom with baud rate settings might be helpful on the ID pin)

Btw "Open Serial Bus" does not mean USB. It is OSB. Especially since such org cannot provide guarantees that USB-IF wouldn't do anything to cause trouble (e.g. reissuing a revoked VID/PID pair). And trademark wise, it is OSB, not USB, and thus is not likely to be confused by consumers (Especially if the logo is kept distinct).
You should also have a strict admittance system to ensure only open source projects are included (at the very least to reduce the incentive for USB-IF to take additional offensive measures).
There is precedence for this however. If you recall about i2c, other companies decide to call compatible implementations as TWI (two wire interface) to avoid paying licencing fees.
USB-IF will not be losing money from this however, since if you are making a normal commercial product (with sizable number of items to sell), you ought to fork up the fee to USB-IF to ensure your product is kosher anyway.
tl;dr: Open, but not Universal. But better than the alternative of forking up $5k for a small open source product..
,Ask YC: what is the future for browser extensions that personalize the web?i'm in a position where i can launch personalization on 30,000 browsers. but i havent - because i'm not sure what the equation with websites, my monetization options, and my users could be.
so i thought i'd ask the community, with the example of a few cases & existing scenarios:
[1] GetGlue provides a check-in mechanism for pages you visit. They basically augment the website with toolbars,links, 'like' buttons, badges & so on & even referral links to 3rd parties
[2] webmynd adds personalization to google
[3] rapportive adds links,and even third party raplets into gmail
Conduit[4] has a toolbar, that triggers personalization within webapges and is in the top 100 websites visited in the world today
my question :
1. will they alienate themselves from content destinations ( their 'hosts' )
2. will they be able to sell advertising on a space owned by the host
here in india, a comparable scenario would be when popular dailies occasionally had a pamphlet that the delivery boy would fill and make some money out of. but guess what. the newspaper sued the advertiser - not the 'enabler'.
that said, there are content/personalization cases where the line is more blurry and tilting towards what the user decides to do.
eg: skype extension[5] that takes numbers on a page and turns them into 'call via skype' buttons.
or more recently google's highlight extension [6] that let's you double click/select random phrases on any page, and it displays a google logo with a search button right there. does this account for monetizing 3rd party content? essentially users of this plugin could be on a yahoo or bing page, select a word and a google search would show up. it's kind of a tricky case of accountability IMHO.
if my users want a site personalized, does that justify my plugin personalizing content/websites?
Or perhaps Cooliris [7] & Facebook's [8] form of bizdev driven personalizaton offer a half way path. I think wibiya [9] has reached great scale and are in a position to offer a non-extension,publisher-controlled personalization experience.

,MixPanel (YC S09); my mini reviewAfter spotting the mixpanel logo at the bottom of HN I decided to give it
a spin on a reasonably serious site to see what it can do. I've got some
issues with GA that I can't seem to resolve so I figured maybe MixPanel
can replace them.
First impression is that it looks really neat and simple, but on my browser
(ff 3.01) the form fields all somehow manage to hang outside the containing
blocks.
The sign up process is very quick, but there is no email verification, which is
a bit of a pain because it could mean that people use a fake address leading
to emails dumped on unsuspecting bystanders.
After signing up you get a secret token and a skeleton piece of javascript
that you can flesh out to track variables that are important. This is mostly
a manual operation, you insert the relevant bits in strategic spots on your
site, 'instrumenting' it so MixPanel can keep track of what is happening.
The upside of this approach is that you, not they decide exactly what gets
tracked and what it is called.
Right after signing up you are offered to get some 'datapoints' if you get
someone else to sign up, that seems a bit premature, I haven't a clue what
datapoints are.
Other than the initial signup form error the design of the site is very clean
and functional, the documentation is easy to read and stuff can be found
more or less where you expect it.
The 'secret' token that gets generated for your site is not that secret
however, since it is plainly visible in every page that has the javascript
embedded in it. Maybe it should be named 'site specific' token ?
Meanwhile the tag is in place on my site now, and registering visitors
according to the live stats, time to read up on the data points.
Datapoints are mixpanels way of making a business out of this, essentially
they charge you 'per event' on your website. The whole thing revolves around
the 'funnel' concept that anybody in internet marketing is familiar with.
Garbage in at the top, and 'espresso' out at the bottom, mixpanel allows you
to track exactly what the loss percentages are at every stage of the process.
Datapoints cost money, and I think they are way overpriced.
The current pricing scheme is:
0...10,000 points: Free
10,000...100,000: $25
100,000...500,000: $100
500,000...2,000,000: $200
2,000,000...10,000,000: $700
Let me explain why I think they are overpriced: at 100,000 points for
$25 (the first 'plan' they have) for any small ad driven website that
has an ECPM < $0.25 they are costing you as much (or more!) for your tracker
as what you were making on your visitors.
And on a for-pay site that makes $20 / month per user, with a COA of $5 and
a 1:2000 conversion rate on a 1:50 new traffic vs old traffic ratio (all of
those numbers are pretty 'normal') you would again be making a net loss.
One of the sites I run that I could have tried mixpanel on gets 3,000,000
pageviews monthly, the ECPM is around $0.11, so it makes $300 /month.
It's a no-brainer because it costs less than $5 to host on a flatrate 100Mbit
leaseweb box. Using MixPanel with that site is out of the question though.
So, you'd have to be buying a very large volume of points in one go to make
it worth your while, but that means a fairly big up-front cost. $700 in
one go is essentially several months hosting cost for many sites. The
price difference between 'volume buys' and smaller buys here is
$c0.007 / hit on the largest plan, versus $c0.025 per hit on the smaller
ones. That's a 350% or so difference. For a virtual product that is
not reflecting the difference in cost to the provider, which essentially
is only the extra cost incurred by the transactions to process the
payments.
MixPanel currently uses Amazon as their payment processor, which
is a pretty good indication you don't need to worry about where your
credit card details will end up.
The real time statistics are neat, but they will also be very expensive for
MixPanel to maintain long term, and they don't seem to add much actual
value, it's more of a gimmick. A functional real-time stats tracker that is
cheap to operate is very hard to design, which is one of the reasons all the
free tracking tools are using batched updates.
Google Analytics also allows funnel analysis using the 'goal conversions', only
they do it for free and a whole lot more besides.
Meanwhile, I've set up a secondary instrumented set of pages, but for some
reason the data never showed up in the reports. I double checked the code
and the javascript error console, no idea what is going wrong there. The
'feedback forum' seems to be mostly enhancement oriented, not set up
to track problems. It is also externally hosted, which means that you leave
the site, it would be better to have a simple ticketing system (a la trac)

Incidentally, uservoice, the site that hosts the forum is listed as a customer
of mixpanel, but they also use analytics and quantcast.
MixPanel will probably work well if you have well defined landing pages and
are a straightforward e-commerce, but at the current pricing levels it is too
expensive for high volume low conversion websites, especially for continuous
deployment. And that's a pity because it is especially those sites that would
benefit most from a tool like this.
You could use it for targeted a/b testing though, but setting up a test
seems to be quite labour intensive and error prone.
MixPanel provides you with csv exports of the reports so you can import the
data in to your favourite spreadsheet.
On the whole I think that the concept of an analytics site that concentrates
on the funnel aspect of operating a web service has promise, but I would
like it to be significantly cheaper and easier to set up. As it is it really can't replace GA for all the other features it offers.

Image tracker for white label softwareMy Saas company lets customers brand our white label software with their logo, corporate images, slogans, domain, etc. There is a slow manual process where a project or account manager has to give the customers marketing team the available branding points along with the requirements (pixels, file type, character length, etc.) The customer’s marketing team isn’t technical or organized, so they screw up providing content that meets the requirements. After the account manager gets the content from the customer and stages it in the software, the customer sees it and is unhappy. They didn’t take into account how bad a logo with written text appears in a tiny image, they wrote a sub header that doesn’t make sense on a particular page, etc. This slows implementation time which ultimately costs us and the customer money.
Instead of mucking around with this, I want to be able to put a set of urls in our software. Then customers can upload the images and text to some management site that validates the images meet the requirements, automatically does conversions if possible or makes suggestions on what is wrong. Then the images get output to some place where the customer can see them in the software for approval. The customer can then approve them and automatically promote them to the prod software. We the white label saas company never are involved since this is just a set of urls we consume.
I need to be able to expense this on my company card so $1000 a year. It sounds like a cms but most CMS systems are over complicated. This is supposed to save time which gets lost if an account manager has to explain something. Contentful seems to be the closest thing but still doesn’t seem set up for this use case..

1. Augmented productivity:
I'm a fan of the gig economy ever since I ordered the first $5 logo design from fiverr. And I'm just starting to explore MTurk. This year I'll put a lot of effort into learning how to combine these with workflow automation services like Zapier, and new AI stuff... I think such methods could multiple personal productivity. Inspired by the guy who automated 90% of his work.

2. Improved startup-building platforms:
It would be such a blessing to multiply the ratio of successful startups, and lower the pain of failing. I mean, 9 out of 10 startups fail even in developed startup hubs. That's one metric that we need to fix. Traditional incubators and accelerators are nice, but not too effective in mitigating risks. I loved how YC started Research (http://blog.ycombinator.com/yc-research), and even more, that there are now so much more startup studios (http://buildtogether.co/startup-studio-list), and finally there's a booklet (http://laicos.com/anatomy-of-startup-studios-is-out/) that explains in detail how these venture builders work.
3.Crowd*:
Besides perk based crowdfunding, there are more and more platforms where you can offer equity in your startup for support. That just adds to the option of the founders to get the money they need... who know, maybe even faster than angel money and with better than vanilla term sheet conditions.

As a marketing instrument the first letter is free of charge, no questions asked, no payment needed. The problem I have now is that a group of people are abusing my system to send out the famous Nigerian scam mail. (I can't believe people still fall for that.)
Besides the fact that it is actually costing me money it also damages BlueMail’s reputation because my logo/url is on the back of the envelope containing the scam letter.
My problem is that I want to stop them while maintaining the low threshold for the real customers.
As far as I can tell they handle the registration process manually, that makes solutions like (re)capcha etc useless.
Any ideas/tips/suggestions ?.
