,I am pissed off with domain leechersHey everyone,

I want to give you a bit of information on why this is so important to new start-ups, and how this issue personally affected me. I am sure you have also come across this problem many times.

Three months ago I purchased a domain name for a startup venture. I have created a launch page, made business cards, created a logo; I have already accumulated a lot of signups in 3 weeks time and done a bit of marketing. I even have a few customers already.

Today I received a totally random email from a guy who is the owner of a very similar domain name. He has sent me a cease and desist letter, because apparently he owns the trademark. I have double-checked this on the USPTO website and everything seems legit.

However what estranges me is the fact that he has not setup a business. He bought the domain in 2010 to setup a company and I believe he quit before he launched. Now he made me an offer to sell the trademark and the domain name, or else desist from using the name. I did not ask him how much he wants for this, because I am sure it will be some crazy 6-digit figure that I will not be able to afford.

Now I have to change my business name.

I am lucky that my startup is still new and I haven't spent a fortune on marketing. Imagine if this was a year down the line... Many founders don't have the flexibility to change names, so they have to pay up.

So dear people from HN, could we please spread out the message on why this is so wrong! Every single time I go to a domain registrar, I can't use 90% of the names, because these domain leechers bought everything to make a profit..
,Ask HN: Help Is it worth rebranding (trademark infringement)?I'm one of the Cofounders of a startup called Super Owl and we are busy working on an iPhone app which delivers spoken word content weekly to subscribers. We have recently been featured as part of a Next Web article about 'How Startups Choose their names' - http://thenextweb.com/insider/2011/12/03/9-startups-explain-how-they-chose-their-names/

This was a nice bit of early press for us and we were surprised but delighted to be approached. However, very soon after this article went out we received a letter from a company stating that we have 'breached their trademarks'. This company is another startup, yet to launch their app publicly, however they claim that they are an established business - see their first letter to us here - https://skitch.com/aishay/guy25/letter1

I e-mailed the following reply:

--------------------------

'Hi ,

I haven't heard of * before - just looked at your website and it looks like a great service.

I'm slightly confused about the letter attached as you state that Super Owl breaches your trademarks - have you registered a trademark for the name 'owl', '' or 'super owl'? Obviously, if it's the latter I can appreciate your concern.

First of all to clarify Super Owl is not a streaming service for audiobooks so it's quite different from what you're doing (we are aggregating spoken word audio podcasts for download). As yet, we also are not related to anything in the book space and our future plans don't include audiobooks.

Owls and audio are what we appear to have in common and I hope we can agree to differentiate ourselves in the market through product, logo, marketing, service etc. A quick search in the iTunes store reveals several apps with the word 'owl' included and I haven't seen this as a major setback or concern.

I hope this puts your mind at ease, however do feel free to contact me if you would like to discuss anything further. You can get in touch by e-mail or give me a call directly on *.

Best of luck on your launch.

Regards,

Aisha Yusaf'

--------------------------

I have now received the following letter as a reply to my e-mail - https://skitch.com/aishay/guy2a/letter2

So, here's my dilemma, do we change our name?... I don't feel like we are infringing any trademarks even though we do share the word 'owl' in both our business names. As we haven't even got a product out as yet we don't want to waste our time or money on legal fees or petty issues but rather concentrate on building, selling and promoting what we make.

The business that has been pursuing us on the trademark issue also doesn't have a product out (even though they speak as though they have) and although we can rebrand what we're doing, as it's not going to make or break our app, I am concerned that by doing so we are being bullied or coerced into doing something which is not even necessary.

At this stage no one really cares about our product and if we're lucky some people might care once its available to use and buy, so we don't have time or energy to spend on the wrong things (such as this).

Any advice, help or suggestions would be most appreciated.

Thanks :).
,Ask HN: How to stop leachers abusing our siteHello,

I run a service called BlueMailCentral.com. That allows you to send a letter (snail mail) from your PC to any country in the world. As a marketing instrument the first letter is free of charge, no questions asked, no payment needed. The problem I have now is that a group of people are abusing my system to send out the famous Nigerian scam mail. (I can't believe people still fall for that.)

Besides the fact that it is actually costing me money it also damages BlueMail’s reputation because my logo/url is on the back of the envelope containing the scam letter.

My problem is that I want to stop them while maintaining the low threshold for the real customers.

As far as I can tell they handle the registration process manually, that makes solutions like (re)capcha etc useless.

Any ideas/tips/suggestions ?.
,Ask HN: What's the worst that can happen if you get sued over a trademark?Let's say you're using a logo for your company that plays off a very popular one. For example, something like McDonald's golden arches but 3 of them. Kind of a gray zone, but enough to probably get someone's attention.

What's the worst that can happen? A cease and desist letter? Can they actually sue you for money?.
,I made a “programming language” based on Cobol syntaxFirst of all, I'm sorry. I'm deeply sorry.

A few months ago, talking with some friends, we had the idea of developing a programming language just for the sake of it. We talked a little about it, design by committee got out of control and, a few days later, we abandoned the project completely without having written a single line of code.

I, though, have wanted to make a programming language my whole life and thus I kept trying to push the project forward by myself. I created a syntax loosely based on that of COBOL, made the worst compiler possible, wrote a somewhat slow "virtual machine" and released LDPL (ldpl.lartu.net) as a joke. Even the name is a pun on older, business oriented languages with BIG-CAPITAL-LETTER-NAMES. Again, like COBOL.

Fast forward a little and the joke got out of control.

I kept working on the language on my free time - pushing the not-very-ortodox but easy to code compiler forward - and the language got pretty usable. I mean, it's not a language you'd like to work with. It can't do everything. It's quite slow. It doesn't have any scoping nor functions (it does have sub-procedures, though) nor lambdas nor objects nor fancy data structures. Think of it more of an esolang than a serious language.

But what it lacks in efficiency and features, it makes up by having a cute dinosaur logo (poorly drawn as a joke on other mascots like the GCC gnu), unicode support, a full standard, comprehensive documentation, fancy examples and a half-written tutorial to be finished in the next days. It's also very portable, with binaries available for Linux amd-64 and ARMv8, Windows 64 bits and even Mac OS X for PowerPC processors!

So, if you are curious, bored or want to try something useless and new, I invite you to visit ldpl.lartu.net, download the LDPL source code or grab a precompiled binary for your operating system and code away.

I'm sure you won't hate it that much..
,Ask HN: False advertising on stock vector websites?I've noticed that a lot of services that sell royalty-free non-exclusive licenses to stock vectors and other images have a lot of images like this: https://www.vectorstock.com/royalty-free-vector/letter-m-c-logo-icon-design-template-elements-vector-21949358 even though on almost all of these services there is a huge clause saying that the use of the image in a logo is explicitly not allowed. When the image itself is suggesting the customer use it as a logo, is this not highly misleading? What am I missing here?.
,Twitter kills bubble letter logotype, replaces it with new Twitter bird logo,Ask HN: Where/How to test user's perception about e.g. your logo?I have been using me logo for quite some time and just yesterday one of my friends told what he sees in the logo and it wasn't nice. I did not see it, neither anyone from my team nor anyone I handed my business card to.
What's in question is the letter F. What do you guys see?
http://www.followmeintravels.com/.
,Ask HN: Where does one find a remarkable designer co-founder?My partner and I have worked together for while now, both in grad school and on our startup projects. We have a reasonable amount of industry experience and get along very well. We're both rather technical, each focusing on different parts of the stack, both decent at hustling and customer development (although we've only done the latter for a limited amount of time, so we're still learning a lot as we go)

We are somewhat lacking from the design standpoint: our web / graphic / interaction design is at best 'meh'. The best solution out there will unfortunately often fall flat if presented inadequately. At this stage we believe in keeping the team to at most 3 people, and that we would be at the strongest with an additional designer-founder.

We would love to find a 3rd founder (SF area, although remote could work) who would take full ownership of the aesthetics of any project we undertake. He/she would own everything, from the logo of the product, to the optimal screenflow, to the pitch deck, to the MVP video. Nobody already knows everything, we certainly learn a lot as we go, but it'd still have to be someone extremely competent and flexible.

Where do we go about finding this unicorn? I feel like the problem is that as techies we're stuck in the universe of developers, with very little intermingling with the art people. It's similar to when business people complain about never finding available developers to work with (I, for example, know tons, but that's because most of my network is made of developers).

Are there online hangouts for that kind of folks? Meetups? Anywhere else where we could locate someone like that?

Thanks a lot!.
,Ask HN: Stock image as website logo: any side effect?I'm building a website. It is bigger than just a side project. Found an image on one of the stock image sites, bought it for $20. I use this image as site a logo. I contacted the artist. Asked him to make few illustrations for my website in the same style. He did. Everything fine so far.

No I'm thinking about uniqueness of this logo image. The picture was sold for a long time on this (and few others) stock image sites. It is still available there.

Should I get (buy) some exclusive rights ? If I do this — what happens to the people who bought this image before?
Should I just add the unregistered trademark™ symbol somewhere near this image and site name?
Should I ask the artist to modify the image to make it unique? (something like adding one or two letters from the site name, "pied piper" style, you know)).
,Ask HN: How can I design a logo such as Tensorflow's?When you look at Tensorflow's logo, it's a 3D object. Two sources shed light on it, hence the "T" and "F" shadowy letters on the wall.

This can be done for many other letters of course. How can I design one for myself? (Assuming I have no experience with Illustrator)

Thank you!

https://www.tensorflow.org/_static/images/tensorflow/logo.png.
,Ask HN: How best to collaborate with designers?Have you ever hired a freelancer to do design work? Did you have a clear idea of what you were looking for, or only a vague notion of what's good and bad?

I fall under 'yes and the latter'. I recently hired a logo designer on eLance and I feel like good communication can make the difference between a mediocre and a great final design. But I'm not super-good at articulating what I like/dislike about an iteration and feel unhelpful giving feedback like 'this logo doesn't feel right'.

So I figure some of you out there must have been in my position before, perhaps they even learned a few things from the experience. Maybe you can share some wisdom or point me to a good article on the subject? It will be greatly appreciated :)

Thanks!.
,Launch HN: Journey (YC W21) – a better tool for selling softwareHi, we’re pclark, bweitz and anilsevim, the founders of Journey (https://journey.io). We want to make buying and selling software a better experience. We do this by allowing sellers and marketers to combine all sorts of content—slides, videos, forms, calendars, text—into one sharable webpage, which they can then easily personalize for specific prospects. Think of it like a website that is specifically designed for a specific individual to take a specific action, which answers any questions or objections they may have.

For example, I took one of our standard demos and made a "personalized" version for HN here: https://jny.journey.io/p/3bbb55f82a224e399aafd2dc04f4f32b?pr.... To customize it, I simply added the YC logo at the top, and a "Welcome HN" video to intro the demo—but you can customize these things as much as you like, as your sales process moves forward.

Edit: here's a further example on top of that one: https://jny.journey.io/p/3bbb55f82a224e399aafd2dc04f4f32b?em.... In response to https://news.ycombinator.com/item?id=27235504, I made a new version of the "Welcome HN" demo by adding a personalized intro video, changing the logo at the top (I just picked a different one arbitrarily), and restricting it to a specific person (note the "only visible to [email address]" text on the right). Of course it's not really restricted, because we want you all to see it, but it's an example of how you can evolve these demos in response to specific people's questions.

Back in 2012 I launched a B2B email marketing startup called Userfox on Hacker News (https://news.ycombinator.com/item?id=4715237), and as that company grew I repeatedly found that it was really hard to create an email that performed well—because if an email is too long users will skim over it, and if it has more than one link they’ll never come back to click them all. Our hope is that Journey helps fix such interactions by allowing you to send users a specific page that has all the content you want them to read, including answers to their specific questions about your product.

Sales people have a hard job, and we don’t think their tools help them enough—they have to rely on live meetings and phone calls. Which is annoying because a live phone call is pretty much the last thing I want to do when I want to actually use a product. You have to talk to a sales person because there isn’t a good way to communicate complexity today in an asynchronous manner.

Sales and marketing is actually ‘just’ storytelling. You build something and then you tell people why they want it. We often think that the latter part is the easy part—but it isn’t! It’s really hard to introduce your product to someone, even when you know they would benefit from it.

If Journey can provide a superior storytelling experience it stands to reason that humans will require fewer live meetings. You don’t need to telephone for a taxi because you have the Uber app.... You won’t need to talk to a human to buy software because you’ll have Journey…

Journey specifically is a web app where you can embed and sequence various pieces of content (videos, slides, forms, calendars, …) and then share that sequence (a “Journey”). You can then take a Journey and personalize it for a specific recipient. Once you’ve shared a Journey, you get insights on where they’re spending time, and any comments they may have. Over time, you and your prospect can build up an entire sales conversation this way, focused around what they specifically need from your product. And you can reuse any bits that worked particularly well in your future conversations with other prospects.

We’d love to know what HN thinks of Journey, here's a link again to our HN demo mentioned above: https://jny.journey.io/p/3bbb55f82a224e399aafd2dc04f4f32b?pr.... From there you’ll be able to sign up, request an onboarding call, view case studies, and learn more. Thank you!!.
