,Ask HN: Could you elaborate why Freenode's “hostile takeover” started?I've been trying to understand the debacle for a while. I now believe it's a regrettable event where both parties genuinely acted defensively against a perceived threat.
The heart of the issue, imo:
Andrew Lee has been sponsoring freenode either directly or indirectly since 2012. He acquired Freenode Limited in 2017, a point of contention. According to all parties, he never tried to exert influence over the network.
PIA's sponsorship started in 2012 and ended with Kape's acquisition. PIA's logo was on freenode.net from 2012-01-2x to 2021-01-05.
Shells' sponsorship started in 2021, the reason Shells' logo was added to freenode.net on 2021-02-25. From this point, former freenode staff considered Andrew hostile.
Consequently, staff revoked Andrew's access to freenode's DNS accounts and refused his requests for that to be undone. From this point, Andrew considered the staff hostile and invoked lawyers to regain control.
Everything that happened after these two events only occurred because both parties were acting, from their perspectives, in defense against a hostile actor.
My question to all of you is, does anyone know if the staff had undisclosed reasons to so quickly assume Andrew's ill intent? This is a person who's been sponsoring the project for 9 years now, and apparently there wasn't _one_ incident to suggest his interest in controlling the network.
In fact, the first party to deviate behavior from the past years was the staff, by revoking Andrew's access. Is there any evidence to Andrew's ill intentions _before_ his access was revoked? Why is everyone treating the Shells logo addition as the first "attack," without a single motive as to why that was now unacceptable?
I understand it was a shock for them to find out freenode was owned by Andrew. But they figuring that out is not evidence that change was coming from his end. Are there any accounts of Andrew trying to exert control since 2012?.

The website in question is a very obvious clone of ours and has both .com and .cn domains: - www.haogegebisai.com - www.chosengamer.com
Basically they copied all the design and even our logo down to the actual URLs.
I've added their CEO on WeChat and inquired about this, and he said they are big fans of our startup. But he also mentioned that they already have investors. Their website launched two days ago and already has a bunch of activity.
We've talked about this internally and hope to be able to gain this startup as a Chinese subsidiary, but we are still unsure if this will actually work out.
From a legal standpoint we are very unsure how much you can actually do in such a case. Should we just wait it out? Our should we aim to litigate to put pressure on their investors? I have some experience in international litigation in cybercrime cases, but from a practical perspective it is very likely to bind a lot of resources and focus.
Another huge problem for us is that we are in talks with a very large Chinese IT company (triple-digit $Bn market cap), and if there is a clone growing in their backyard they might pass on us.
It'd be great if people with more experience in these things could give us some advice.

,Request HN: Designers – Shellshock vulnerability needs a logoI'm not a designer, but as others have pointed out, The Shellshock vulnerability will be communicated better and taken more seriously with a good logo, as Heartbleed had.
If anyone with design skills can put one together, and get word out, I think it would be helpful for everyone, let me suggest an octothorpe (#) made of arcing electricity (lightning or similar), but take it where you like, it just needs to be simple and catchy.
I recommend explicitly placing it in the public domain, or CC licensing it for resuse, so no one thinks twice about using it in their news stories.
I'm not familiar with the logo buying/selling sites, but if someone put up a page that allowed donations for a good logo, I'd put in a little, and I suspect others would too, given a permissive license or public domain of course..
,Ask HN: I'm 17. Should I drop school for YC S12?I'm extremely interesting in applying to Y Combinator for this summer. The only problem is that I'm still in Cegep (a two-year college for Quebec students before they go to university - I'm 17) and so if ever I get chosen, I still have one more year remaining to complete my program (International Baccalaureate in Pure & Applied Science).
I don't think I would drop it, because I ultimately intend to go in computer science at Stanford. Therefore, I would have to leave the Bay Area at the end of August in order to move back in Quebec and stay there during the year and come back in the summer when I'm finish my program.
I would still have time to work on my startup during the year, but at a much lower pace (2-3 hours each night and 8-12 hours on weekends). The other guy on my team (he's 17 too) is in a much less intensive program then me and he could continue working almost full-time on the startup.
Yet, if you guys tell me that I would absolutely need to continue working full-time on my startup, I will consider dropping school more seriously. It would be hard for me, but if it's really necessary I could do it. The thing is, the program I'm currently in, International Baccalaureate, is a program that I must complete in two years. The special thing about this program is that we are the same group for every class (we started 40 now we're 28). If I drop/fail a course, I'm out. And I then need to go in regular science. If ever I were to be selected for YC, the choice would be quite hard as I said, because I really enjoy my program, I'm fond of the other students and I appreciate the teachers a lot. And I also fear that I won't go back to school if I enter the startup world.
At least, I'd like to finish my program and then maybe take a break from school to focus on my startup. My program requires a lot of effort, it's considerably more challenging than regular science, and I just don't see myself dropping it when I'll be halfway through it, but still there's a lot of chance I would - it's 50/50. I'm constantly debating in my head whether I should drop or stay, but I guess I'll wait to see if I'm selected for YC to make a final decision. Ultimately, I feel I would drop my program, because YC is such an amazing opportunity and also because I have a very good co-founder who is a long-time friend of mine. He would definitely succeed in convincing me :P
Moreover, I'm the only one writing code. My co-founder (who's currently studying in Business Management) will be working on the marketing (posting on the blog, making videos showcasing the app, posters in schools and other places, talking with other companies so that they use our app, etc.) I also have a graphic designer that will not be directly involve in the startup but that will do my logo and help me design icons, textures, etc.
Without even knowing anything about my idea (I can tell you though that even if I'm the only technical founder, it's not an overwhelmingly complex app and I am confident that I could manage the coding alone. All features would get implemented during the summer. During the year, I would only make little changes to the user interface and update the content of the app, but I probably wont implement radically new features, that is if I choose to stay in school. The goal during the year would be to get as much users as possible and thats exactly what my co-founder would be working on full-time. Complex new features would get implemented in the following summer.), because really I don't want to be chosen for my idea but rather for my team (I've got this interesting idea that I want to work on, and I like it because I would actually use the app, and actually, Ive got a bunch of startup ideas (Im the kind of guy that always has tons of ambitious projects going on and new ideas in mind: I want to code apps, make feature films and crazy edits, learn new monologues by heart, run marathons, travel around the world and learn new things!), but this particular one is not too complex to implement, yet if it turns out that I choose to do a completely different project, then so be it! Anyway, I dont think the idea I apply with matters that much (but it ought to be good obviously), because anybody could apply to YC with a similar idea and develop a similar app. But would they really be as much passionate as us about the app and as much caring about the users, would they achieve to convince companies of using it, would they convince people of using it? I know we would. My point is that Im expecting to be chosen a lot more because of my team than because of my idea. I want to build useful products and it thrills me that with the internet millions of people could be using them! But what thrills me even more is that if ever I do YC, I would be hanging around with dozens of other developers that are in the same situation as me. And thats exactly why I want to do YC: for the experience.), do you think I have any chance of getting selected? Or should I wait for next summer, when I will have finish my program? The thing though is that I will still continue to go to school (Stanford, MIT, McGill or somewhere), so again I will have the same problem as the one I have right now.
I truly enjoy school but the real reason I want to go in c.s. at Stanford is to meet other c.s. students and start a startup with them. I'm also interested in studying in theatre, so I'm really not dropping school soon. But I don't want to wait after university to finally apply for YC, I feel ready now. The reason I want to go through YC is to meet interesting people, discuss ideas and because I'm sure it would be a tremendous experience. If I don't get chosen, I will still develop my app over the summer, but I just think YC is an outstanding opportunity and that I ought to at least submit an application. I will continue submitting applications every summer until I'm chosen.
P.S. As a developer, I'm not that skilled, but I always manage to figure things out by myself and find a way to do what I want. If I'm stuck, I don't easily give up. Nevertheless, I'm more of an idea guy. I'm currently following tutorials from http://www.raywenderlich.com/store since December in order to get more familiar with the iOS 5 SDK. When I'll finish them, I'll look at the Parse SDK (http://parse.com) and then at the Facebook iOS SDK (https://developers.facebook.com/). I will then code an app similar to FML but it will be called 'You know you're in IB when...', IB being the program I'm currently in. I will integrate the Parse SDK and the Facebook iOS SDK in this app. It's a simple app that I want to do for testing purposes and also because I know that my other classmates would actually use it and that fact motivates me a lot. I will then start working on the real app that I want to do for my startup. My goal is to have a working app with bare minimum features for the end of May so that I have something to show if ever I move to the Bay Area. I'm working toward this goal 2-3 hours everyday and 8-12 hours on weekends..
,A Page From A DiaryI mean, what is a guy like me supposed to do right? I could stop smoking so as to be better off financially hence able to indulge in activities, but have I not been trying? Have I not been trying for the past 3 months or so and seriously trying for the past at least month?
What is a guy like me supposed to do? Very poor, very intelligent, minimal social contacts. What, what are my options? Follow my career path, yes of course, but am I to suffer for the next 3 years? Am I to go on still as I have for the past seven years?
You know I’ve pored my heart to that website. I have spent god knows how much time on it and finally I achieved near perfection and you know what happens? It has been shut down because I have been unable to afford my bill and instead focused on getting money to feed my habit rather than pay the fuckin bill. I nearly achieved perfection you know. I vertically aligned it which has given it a very clean and simple look and today finished my header with a little cute logo on it, it was just, it was just the stuff of passionate and determined hard work and what happens? It gets closed.
Now! Now that it has gone from only 2 people to 20. Now, now that I sorted out all the adverts! Now, now that i finally finished design aspects!
It is always drama with me isn’t it? It is always at the edge of failure, always at the edge of the unattainable, always at the edge. Such position does indeed at times give me such deep and utterly profound emotions never experienced before, but god knows what it does to my physical wellbeing.
I have been seeing convincing similiarities between dreams (as in sleep time dreams) and reality. One of the most startling but at the same time edglite is this conviction of the reality that is held with dreaming. In no way, at no point, most of the time while dreaming, do I doubt its reality. It is assumed, it is not a dream until I am awake. Sometimes I go to the edge and ask whether it is infact a dream. Very rearly do I succeed in such realisation; in fact I can not recall a time that I have.
I do recall being at the edge tho, at times thinking that it might be a dream, but not unlike in real life such thoughts are shaken off rather quickly. There is no seriousness in considering the question, it is from the moment that it is made intuitively untrue. That our intuitions might lie to us I have not thought of, but that they do I am unable to doubt. There are many instances when awoken I ask why did I not go ahead and do that, Why was I held back by other considerations, it was just a fucking dream.
It is not hard to imagine myself waking up in some bed in some house the moment I die. What I will remember I am unable to say, probably nothing. What i would expect though is familiarity not only with the environment surrounding me, but myself and my life which clearly right now I have no clue of what it is. Sometimes I see dreams which present characters or events which are familiar to me. They are familiar because I had dreamed of them before. It might be my mind playing while I am asleep, maybe it has run out of content, but I do not think that there is anything truer in life than this: Whatever I have wished for it has been granted to me. Even a character for heavens sake. Anything, any fucking thing I have wished for has come to materialise. So what am I to make of it? What else but that reality is a dream as real as reality itself. I have though decided not to use wishes. It feels as if I am selling my soul to setan because every wish that has come to pass has had more nightmares than dreams. I wish to feel, experience everything that life throws at me and indeed embrace the rality aspect of what might aswell be a dream. I feel weary of easy taking and giving for if each dream was ment to be like i wished it then it surley would have been so.
The last dream I saw was a rather fascinating one because I had arrived at an insight about something. I was dealing with a complex problem but the complexity lay in my perception of a given something rather than on that given something itself. I though, when I woke up, that I had been discussing a truth which was being revealed and explained to myself. The dream I think ended with my grasp of such truth, the last words probably were Ahha. So why do I bring this up? Because excitement and other emotions which are brought up in certain unique circumstances would vanish in a world in which what one wishes materialises. There would be no secrets to be revealed in such world, no struggles to be overcomed and no joy to be felt..

This was a nice bit of early press for us and we were surprised but delighted to be approached. However, very soon after this article went out we received a letter from a company stating that we have 'breached their trademarks'. I'm slightly confused about the letter attached as you state that Super Owl breaches your trademarks - have you registered a trademark for the name 'owl', '' or 'super owl'? Obviously, if it's the latter I can appreciate your concern.
First of all to clarify Super Owl is not a streaming service for audiobooks so it's quite different from what you're doing (we are aggregating spoken word audio podcasts for download). As yet, we also are not related to anything in the book space and our future plans don't include audiobooks.
Owls and audio are what we appear to have in common and I hope we can agree to differentiate ourselves in the market through product, logo, marketing, service etc. A quick search in the iTunes store reveals several apps with the word 'owl' included and I haven't seen this as a major setback or concern.

So, here's my dilemma, do we change our name?... I don't feel like we are infringing any trademarks even though we do share the word 'owl' in both our business names. As we haven't even got a product out as yet we don't want to waste our time or money on legal fees or petty issues but rather concentrate on building, selling and promoting what we make.
The business that has been pursuing us on the trademark issue also doesn't have a product out (even though they speak as though they have) and although we can rebrand what we're doing, as it's not going to make or break our app, I am concerned that by doing so we are being bullied or coerced into doing something which is not even necessary.
At this stage no one really cares about our product and if we're lucky some people might care once its available to use and buy, so we don't have time or energy to spend on the wrong things (such as this).
Any advice, help or suggestions would be most appreciated.

This is my first post, I hope you guys can help. I am doing some marketing work for a small startup job board for medical device professionals (http://meddevicejobs.com). We had a logo and brand designed in 2004 by a design firm here in Phoenix, AZ.
Just recently, I noticed a different local design firm using a logo almost exactly like ours. This is the first I've heard of them, so I sent a sarcastic tweet from the company account, just 'Cool logo.' They tweeted back that it was cool and it's interesting that they've had it trademarked for 'many years.'
Next I get an email from them asking me to take our logo down because it infringes on their trademark. I looked up the trademark and they have the 'M' thingy trademarked, but reversed. The trademark was for 2008. We had this logo in 2004. We didn't trademark it as we didn't think it was necessary and we put our money elsewhere.
What is the best thing to do?

This is my first web startup, but I've run two successful companies in the past. One wrote shareware for the (original) Palm OS platform. The other consisted of three computer retail/repair stores here in the North West. Both companies were eventually sold (at profit) as I wanted to try other things.
I'm looking for someone with excellent UI and design skills to join as co-founder. Knowledge of html and css is essential. You would be responsible for all aspects of design including logo, branding and of course the web pages. I'm now working on this full time and I'm looking for someone who can commit at least 20 hours a week. I know this is probably the opposite of what most people here want to do, but I work right now at a fairly small company (doing mostly development / deployment / have lots of this company and technology specific experience) and I'm going to an interview for a job in an international IT company who's logo you are likely to see somewhere around you right now. The destination position is in r&d / development.
After hearing a lot of good and bad things about big corporations, I really want to find some questions that I can ask in order to avoid a disaster. If you ever worked in such environment / know more about it, could you post some things I can ask and what kind of behaviour from their side says 'run and don't look back'? I will have separate meetings with both a manager and with technical people. As far as I know, technical side is pretty decent (re. quality control and testing) and they're not treating people like slaves there (in that dept. at least ;) )
Any advice would be highly appreciated.

,Ask HN: My cofounder disappeared. What should I do?About six months ago I was contacted by a HN member who had a decent startup idea, good design skills, but no programming skills. We decided to work together to create a dating website that focused around the concept of posting a date idea, then seeing who might want to join you for that date. In this way the site matches people based on what they want to do, not who they are.
To make a long story shorter, the idea grew and morphed, as we went through design revisions and code refactoring. The original idea of the dating site was broadened into a more general event broadcasting site, like Twitter but specifically for parties, concerts, and other events. I also came up with a few other ideas (they key ones that make the web app stand out) that I won't give away.
But now my cofounder appears to have disappeared. We communicated by email and chat, and all I know of his physical location was that he lived in the Middle East. I haven't heard from him in long enough that it seems likely that he had an accident or some other unfortunate circumstance.
So I'm left wondering what I should do. Should I try to replace him? Might there be legal issues if I do so? We never wrote up a serious contract, just an informal email in which we decided in favor of a 49%/51% division, with me holding 51%.
In the absence of my cofounder I have completely changed the design, and have reworked the site's entire focus. At this point there is literally no relation to the original idea of the dating site.
Without giving away all the details that make my startup idea special, the web app is now focused on bands and their fans, allowing bands to broadcast news and gig schedules, and allowing fans to follow bands and broadcast which gigs/concerts they will attend.
There is really nothing left of the disappearing cofounder's original idea, and all that is left of his original design is the logo.
So to summarize the situation I am in: I have a great startup idea (All ingredients of which are mine, but could possibly be considered derivative of the idea of a disappeared cofounder).
What I need is a cofounder who can help with some design issues, put together a new logo, and who also has good marketing skills. Programming skills would be an added bonus. Primarily what I need is a designer and marketer.
This is an ask HN post so here are my questions:
Is there anything I should do about the original disappearing cofounder?
Could there be legal issues with replacing the cofounder even though I have changed the startup's basic principles completely and never had a serious contract with the cofounder?
If you have applicable skills, would you like to be my new cofounder, or do you know someone who might?.
,Ask HN:Getting a client to pay for their site?Three months ago I began a project for two guys(them US me China), who wanted a webapp.
I have no portfolio so they wouldn't make any down payment, fine I thought, and told them they can pay when it's done(stupid, slightly desperate me).
Everythings done except the style, it does everything they want and more(they seem genuinely happy with this).
Now they're taking ages to decide, I sent them logo's and templates to choose from (in their prefered choice of colour) a week ago and have heard nothing since.
This was to be done by the start of July, and the only reason it's not is because they're stalling.
I think because they haven't had to pay for it yet then they feel they have no reason to hurry.
It's only $3000, how can I get them to pay, or what are my options to monetise the site(ebay?) if they don't want to pay?.
,Ask HN: How to get this fraudulent copy of our website shut down?I run AutoTempest.com, a car listings search engine. A few weeks ago, someone registered autoStempest.com, with an extra 's'. They copied our logo and branding, as well as faking other information, such as their team and location. (For example, their "CEO" is actually the CEO of Edmunds.) They've taken other steps to appear legitimate, such as creating a fake Yelp profile and reviews.
From what we've heard from our users, they're creating fake craigslist listings, and when people contact them, they're directing them to links on their site, claiming to be "Auto Tempest". Then they solicit payments (presumably reservations or down payments, if not complete sight-unseen purchases), while using our name recognition to gain trust.
We've determined that their registrar is Namecheap (as is ours, coincidentally), and they are hosted by a company called Quasinetworks, NL. Interestingly, if you google that company, the first result is someone complaining about how they were unresponsive to abuse notifications; not a great sign. We did sent a message to their abuse contact, but haven't heard back. We also contacted Namecheap and did get a reply, but it appears they will only take down a domain with a) a court order, b) potentially a request from law enforcement, or c) a UDRP proceeding: https://www.icann.org/resources/pages/help/dndr/udrp-en
The problem with options c or especially a is that they're costly, and nothing would stop whoever is behind the site from simply registering a new confusingly similar domain. So, to start with we've submitted a report to ic3.gov, the FBI's Internet Crime Complaint Center. Hopefully if they confirm the site is fraudulent, they can request that Namecheap yank the domain. I've never submitted such a complaint before though, so I have no idea how responsive they are.
Is there anything else we could do to shut these scammers down?.
